ScoutLink FMP Terms & Conditions

1. Agreement to Terms

These Terms & Conditions ("Terms") govern your access to and use of ScoutLink FMP platform services across Australia and the United Kingdom. By registering an account or accessing the platform, you agree to be bound by these Terms, our Privacy Policy, and our Community Standards.

2. Definitions

• Player: An athlete registered to showcase performance, record statistics, and apply for trial events.
• Coach: A technical professional registered to manage squad rosters, evaluate trialists, and apply for coaching vacancies.
• Club: An accredited football organization registered to manage teams, host trials, list vacancies, and manage staff.
• Guardian: A parent or legal guardian responsible for approving and supervising a linked Minor user (under 18).
• Minor: Any user under 18 years of age registered on the platform.

3. Account Registration & Eligibility

Users must be at least 18 years of age to register an independent account. Minors under 18 must receive verified Guardian approval prior to account activation. Users warrant that all registration details and credentials provided are accurate and complete.

4. User Roles & Account Responsibilities

Clubs are legally responsible for all actions taken by assigned staff members (Head Coach, Assistant, Scout, Analyst). Coaches warrant that all uploaded licenses, WWCC/DBS checks, and accreditation documents are active, genuine, and legally valid.

5. Acceptable Use & Prohibited Conduct

Users must NOT:

• Engage in unmonitored or non-compliant communications with minors.
• Harass, bully, defame, or abuse any player, coach, referee, or administrator.
• Upload fraudulent accreditation certificates or falsify trial scores.
• Scrape, harvest, or compile platform data for unauthorized commercial use.
• Bypass pre-send safety filters, rate limits, or AES-256 encrypted scouting notes.

6. Intellectual Property Rights

All platform designs, software code, logotypes (ScoutLink FMP), and trademarks are owned exclusively by ScoutLink FMP. Users retain ownership of original videos and portfolio content uploaded to their profiles.

7. Subscriptions & Billing

Subscription plans (Free, Plus, Pro) renew automatically per billing cycle via Stripe unless canceled beforehand. Refunds are granted solely in accordance with statutory consumer protections in Australia (ACL) and the UK.

8. Limitation of Liability & Disclaimers

ScoutLink FMP provides a digital recruitment ecosystem but does NOT guarantee squad placement, trial selection, or professional recruitment offers. Services are provided "as is" without implied warranties.

9. Account Termination & Auto-Restriction

We reserve the right to suspend or ban accounts that breach these Terms, trigger automated Warning Counter escalations, or submit fraudulent accreditation documents.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia for Australian residents, and England and Wales for UK/European residents.
